Welcome to Derg Customs. By accessing our website, placing an order, or purchasing any product from Derg Customs, you agree to the following Terms & Conditions. Please read these terms carefully before making a purchase.
1. General
Derg Customs specializes in custom-designed and/or custom-printed minifigures, parts, accessories, and related collectible products.
By purchasing from Derg Customs, you confirm that you have read, understood, and agreed to these Terms & Conditions.
We reserve the right to update or modify these Terms & Conditions at any time. Changes will apply from the date they are posted to our website.
2. Independent Customizer Disclaimer
Derg Customs is an independent customizer and is not affiliated with, authorized by, sponsored by, or endorsed by the LEGO Group.
LEGO® is a trademark of the LEGO Group of companies, which does not sponsor, authorize, or endorse Derg Customs or its products.
When genuine LEGO® elements are used as the base for customized products, those elements have been independently modified by Derg Customs or its production partners.
3. Custom Products
Many Derg Customs products are custom-made, custom-printed, hand-finished, produced in limited quantities, or otherwise manufactured specifically for our store.
Because of the nature of custom manufacturing, minor variations may occur between individual products. Small differences in print placement, color, alignment, finish, or other characteristics may occur within reasonable manufacturing tolerances and do not necessarily constitute a defect.
Product images, digital renders, prototypes, and promotional images are intended to represent the final product as accurately as reasonably possible. Actual products may have minor differences.
4. Orders and Payment
Customers are responsible for reviewing all order information before completing checkout, including products, quantities, shipping information, and payment information.
An order is not guaranteed until payment has been successfully processed and the order has been accepted by Derg Customs.
We reserve the right to refuse or cancel an order in circumstances including suspected fraud, payment issues, pricing or inventory errors, technical errors, abuse of our store policies, or other reasonable circumstances.
If Derg Customs cancels an order that has been paid for, the applicable amount paid for the canceled items will be refunded.
5. No Cancellations
ALL SALES ARE FINAL.
Once an order has been successfully placed, customers may not cancel the order.
This policy applies to standard orders, limited releases, made-to-order products, custom products, and preorders unless otherwise required by applicable law.
Please carefully review your order before completing your purchase.
6. Refunds and Returns
Due to the custom and limited-production nature of our products, Derg Customs does not accept returns, exchanges, or refunds for change of mind or shipping.
A customer will not be entitled to a refund simply because they:
● Changed their mind after purchasing;
● Ordered the wrong item or quantity;
● No longer want the product;
● Found another product elsewhere;
● Failed to read the product description;
● Dislike a minor manufacturing variation that falls within reasonable production tolerances; or
● No longer wish to wait for a preorder or made-to-order product within its disclosed or reasonably updated production timeline.
Nothing in this policy is intended to eliminate rights or remedies that cannot legally be waived under applicable consumer protection law.
7. Damaged, Defective, or Incorrect Items
If you receive an incorrect item or a product with a significant manufacturing defect or shipping-related damage, please contact Derg Customs promptly after delivery and provide your order information along with clear photographs showing the issue.
Derg Customs will review eligible claims individually.
If we determine that an item qualifies for a remedy, Derg Customs may, as appropriate and subject to applicable law, provide a replacement, replacement component, store credit, or refund.
Normal manufacturing tolerances and minor cosmetic differences are not automatically considered defects.
8. Preorders
A preorder is a purchase of a product before it is ready for immediate shipment.
By purchasing a preorder product, you acknowledge that:
● The product may still be in development, manufacturing, printing, packaging, or transit;
● Any announced release or shipping date is an estimate unless explicitly stated otherwise;
● Manufacturing and fulfillment delays may occur;
● Production schedules may change because of circumstances outside Derg Customs’ reasonable control; and
● Your order may not ship until all applicable preorder items are ready.
Estimated release and shipping windows are provided in good faith but are not guaranteed delivery dates.
Unless otherwise required by applicable law, preorder purchases remain subject to our cancellation and refund policies.
9. Shipping
Customers are responsible for providing a complete and accurate shipping address.
Derg Customs is not responsible for delays caused by shipping carriers, customs authorities, weather, incorrect addresses supplied by customers, or other circumstances outside our reasonable control.
Delivery estimates provided by Derg Customs or shipping carriers are estimates and are not guaranteed unless the applicable shipping service expressly provides such a guarantee.
Customers are responsible for monitoring tracking information associated with their shipment.
10. Lost or Missing Packages
If a package appears to be lost in transit, customers should contact Derg Customs so that the shipment can be reviewed and, where appropriate, a carrier claim can be initiated.
A package being delayed does not necessarily mean that it has been lost.
For packages marked as delivered by the shipping carrier, customers should first check the delivery location, household members, neighbors where appropriate, and contact the carrier.
Any remedy for a lost shipment will depend on the circumstances of the shipment, carrier investigation, available insurance, and applicable law.
11. International Orders, Customs, and Import Fees
International customers are responsible for any customs duties, taxes, import fees, brokerage fees, or other charges imposed by their country or local authorities unless Derg Customs expressly states otherwise at checkout.
Customs processing may delay delivery.
Derg Customs does not control customs agencies and cannot guarantee how quickly an international shipment will clear customs.
12. Limited-Edition Products
Certain Derg Customs products may be produced in limited quantities.
Availability is not guaranteed until an order is successfully accepted. Products may sell out at any time.
Derg Customs does not guarantee that sold-out or discontinued products will be produced again.
We may establish reasonable purchase limits for limited releases and may cancel quantities exceeding those limits.
13. Product Use
Derg Customs products are primarily intended as collectible products unless otherwise stated.
Customers are responsible for following any product-specific warnings or age recommendations displayed on the product page or packaging.
Products containing small parts may present a choking hazard and should be kept away from young children where appropriate.
14. Intellectual Property
Unless otherwise stated, original Derg Customs branding, website graphics, photography, product presentation, original artwork, packaging designs, and other original materials created by or for Derg Customs are protected by applicable intellectual property laws.
Purchasing a physical product does not transfer ownership of Derg Customs’ intellectual property or grant permission to reproduce, manufacture, distribute, or commercially exploit Derg Customs’ original designs.
Third-party trademarks, characters, brands, and intellectual property remain the property of their respective owners.
15. Unauthorized Resale and Commercial Reproduction
Unless otherwise agreed in writing, purchasing a Derg Customs product does not grant permission to reproduce, duplicate, manufacture, or commercially distribute copies of the product or its original artwork.
Derg Customs may establish quantity limits or other measures intended to protect limited releases and prevent abusive purchasing practices.
16. Website Information and Pricing
We attempt to ensure that product descriptions, prices, photographs, inventory information, and other website content are accurate.
However, typographical, technical, pricing, or inventory errors may occasionally occur.
Derg Customs reserves the right to correct errors and, where legally permitted, cancel or adjust affected orders. If an order is canceled by Derg Customs because of such an error after payment has been collected, the applicable amount will be refunded.
17. Promotional Codes and Discounts
Promotional codes and discounts may be subject to expiration dates, product restrictions, minimum purchase requirements, or other conditions.
Unless expressly stated otherwise, promotional offers cannot be combined.
Derg Customs reserves the right to reject or cancel improperly obtained, duplicated, manipulated, or fraudulently used promotional discounts.
18. Fraud and Chargebacks
Customers should contact Derg Customs regarding legitimate order problems before initiating a payment dispute when reasonably possible.
Fraudulent chargebacks, false claims of non-delivery, or other intentional payment abuse may result in future orders being refused and may be contested using applicable order, tracking, delivery, and communication records.
Nothing in this section restricts a customer’s lawful right to dispute an unauthorized or legitimately disputed transaction through their payment provider.
19. Limitation of Liability
To the fullest extent permitted by applicable law, Derg Customs will not be liable for indirect, incidental, special, or consequential damages arising from the purchase or use of our products or website.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
20. Privacy
Customer information collected through the Derg Customs website will be handled in accordance with our Privacy Policy and applicable law.
Payment information may also be processed by third-party payment providers according to their respective terms and privacy policies.
21. Governing Law
These Terms & Conditions will be governed by the laws applicable to Derg Customs’ business operations, without limiting any mandatory consumer rights that may apply based on the customer’s location.
22. Severability
If any provision of these Terms & Conditions is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
